1. Introduction

Welcome to ColorAI, operated by Weatherlight AB, registered in Sweden ("we," "us," or "our"). By accessing or using our AI color palette generator app ("App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using ColorAI. If you do not agree with these Terms, please do not use the App.

2. Use of the App

ColorAI takes input of free text creative briefs and generates color palettes that include color codes and sensory and cultural references to explain why the colors were picked.

User Responsibilities

• Accuracy: You are responsible for providing accurate and complete information about yourself and when providing input to the system.
• Compliance: You agree to use ColorAI in compliance with all applicable laws and regulations.
• No Misuse: You agree not to misuse the App by attempting to gain unauthorized access, distributing malware, or engaging in any activity that disrupts the App's functionality.

3. Rights to Use Generated Content

Generated Color Palettes and Texts

You have the right to use the color palettes and contextual explanations generated by ColorAI for any purposes, including commercial purposes.

4. Intellectual Property

Ownership

All content, features, and functionality provided by ColorAI, including but not limited to text, graphics, logos, and software, are the exclusive property of Weatherlight AB and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

License

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use ColorAI for personal, non-commercial purposes. This license does not include the right to modify, reproduce, distribute, or create derivative works based on our content, features, or functionality without our explicit written consent.

5. Data Protection and Privacy

Our use of your personal data is governed by our Privacy Policy, which is in compliance with the GDPR. By using ColorAI, you consent to the collection, processing, and storage of your personal data as outlined in the Privacy Policy.

6. Disclaimers and Limitation of Liability

No Warranties

ColorAI is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee that ColorAI will be error-free, secure, or available at all times.

Limitation of Liability

In no event shall Weatherlight AB, its directors, employees, partners, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use or inability to use ColorAI.

Indemnification

You agree to indemnify, defend, and hold harmless Weatherlight AB, its directors, employees, partners, and affiliates, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to ColorAI; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or (iv) any claim that your use of ColorAI caused damage to a third party.

7. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or ColorAI shall be subject to the exclusive jurisdiction of the courts located in Sweden.

8. No Refund Policy

All transactions made through ColorAI are final. We do not offer refunds for any services or products, including but not limited to the generated color palettes and associated contextual explanations. By using ColorAI, you acknowledge and agree to our no-refund policy.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any changes by posting the new Terms on our App and, when required, via email. You are advised to review these Terms periodically for any changes. By continuing to access or use ColorAI after the revised Terms have come into effect, you agree to be bound by the updated or modified Terms.
